Virginia Property Owners' Association Act (Va. Code Ann. Title 55.1, Chapter 18, §§ 55.1-1800 to 55.1-1836)Governs Virginia property owners' associations and the developments they administer (Va. Code Ann. Title 55.1, Chapter 18). Former Title 55 was repealed and recodified into Title 55.1 effective October 1, 2019. Covers definitions, association charges, access to records and meetings, board of directors meetings, adoption and enforcement of rules and the related charges, and the lien for assessments with enforcement by judicial or nonjudicial foreclosure.Official source
§ 55.1-1800
Defines the terms used throughout the Property Owners' Association Act, including association, board of directors, capital components, common area, declarant, declaration, development, lot, lot owner, professionally managed, property owners' association, resale certificate, and reserve study.
§ 55.1-1805
Bars an association from charging fewer than all lot owners except for a fee for services, a charge related to common-area use, or a fee expressly authorized by statute, while preserving the association's authority to levy assessments to meet its obligations, with Common Interest Community Board enforcement.
§ 55.1-1815
Requires the association to keep detailed financial records and make books and records available to members in good standing for a proper purpose, lists the categories that may be withheld and the redaction rule, caps copying charges, and sets the notice and voting rules for association meetings.
§ 55.1-1816
Requires board and committee meetings where association business is discussed to be open to members, sets notice and agenda-packet availability rules, allows members to record open meetings and requires a comment period, and limits and governs executive sessions.
§ 55.1-1819
Gives the board power to adopt and enforce rules on the common areas and assigned responsibilities, to suspend services and assess charges for violations, sets the due-process notice and hearing requirements, and caps violation charges at $50 per single offense or $10 per day, treated as an assessment for lien purposes.
§ 55.1-1833
Creates the association's lien for unpaid assessments, sets its priority and the 12-month perfection deadline by filing a verified memorandum in the circuit court clerk's office after at least 10 days' certified-mail notice, and authorizes enforcement by judicial foreclosure or, only if the sums secured exceed $5,000, by nonjudicial foreclosure under the detailed procedure in subsection J.
