Florida community association statutes

Florida statutes are published by the Florida Legislature on Online Sunshine (leg.state.fl.us) - free, clean HTML, no account required. The three community association acts and the nonprofit corporation act are the statutory foundation for every HOA, condo, and co-op in Florida.

Chapter 718

Florida Condominium Act

Primary statute governing Florida condominium associations. Board authority, reserve requirements, SIRS mandate, estoppel certificates, fines, elections, and owner rights.

Chapter 720

HOA Act

Governs Florida homeowners associations - board operations, owner meetings, budget adoption, architectural control, estoppel certificates, and enforcement procedures.

Chapter 719

Cooperative Act

Governs Florida cooperative associations - ownership structure, proprietary leases, share-based governance, and SIRS requirements.

Chapter 617

Florida Not For Profit Corporation Act

Governs nonprofit corporations in Florida. HOA and condo associations incorporate under Chapter 617; this act fills gaps not addressed by Chapters 718 or 720.

DBPR & state regulators

Florida's Department of Business and Professional Regulation (DBPR) is the primary regulator for condominium and cooperative associations and is the sole licensing authority for community association managers (CAMs) and management firms in Florida.

DBPR Division of Condominiums, Timeshares and Mobile Homes

Regulates Florida condominium and cooperative associations. Lookup registered associations, file complaints, and access SIRS guidance.

DBPR CAM license lookup (individual managers)

Verify a CAM or community association management firm license (license type 3801 / CAB). Free CSV download of all active licensees.

DBPR Elevator Safety - registered elevator companies

Verify a registered elevator company or certified elevator inspector (required annually for condo/HOA buildings under F.S. 399.13).

Florida Board of Professional Engineers (FBPE) - licensee search

Verify a Professional Engineer (PE) who performs reserve studies, milestone/SIRS structural inspections, and special inspections for associations.

Entity registry - SunBiz

Florida associations incorporate as nonprofit corporations registered with the Florida Division of Corporations (SunBiz). Search SunBiz to verify an association's corporate registration, formation date, registered agent, officers, and current status.

County recorder portals - all 67 counties

Florida land records are recorded at the county level by the Clerk of Court & Comptroller in each county. Governing documents - declarations, CC&Rs, bylaws, and condo plats - are recorded here. The access method and cost vary by county; 66 of 67 Florida counties provide free public search.

Florida has approximately 1,900 active Community Development Districts (CDDs) - independent special districts authorized by Chapter 190 that finance and maintain community infrastructure. CDDs often coexist with HOA or condo associations within the same development.
