What the law requires
Both acts require owners to comply with the condominium instruments or the declaration, and both give the association remedies for a violation, including fines and suspension of privileges, where the instruments authorise them.
What it means for boards & managers
The authority to fine comes from the instruments as well as the statute. If the declaration does not grant it, the statute alone will not carry a fine.
