What the law requires
Under both the Georgia Condominium Act and the Property Owners' Association Act, common expenses are allocated and assessed as the instruments provide, and unpaid assessments become a lien on the unit or lot. Both acts route enforcement of that lien through judicial foreclosure.
What it means for boards & managers
Georgia's lien is real but it is enforced in court, so the cost and timeline of collection should be weighed before the account is referred. Special assessment authority and the protections lenders and buyers get on conveyance are set out separately.
