What does this tool check in my Colorado governing documents?

The analyzer scans your uploaded CC&Rs, declaration, or bylaws for clauses that Colorado Common Interest Ownership Act (C.R.S. § 38-33.3 et seq.) or federal regulation may have already rendered unenforceable. Every document is screened against three federal checks: FCC OTARD satellite/antenna rules, the Fair Housing Act, and the Freedom to Display the American Flag Act. Where Common Elements has authored the state-specific rule set, the scan adds checks under Colorado law. What file types are supported?

PDF (text-selectable, not image scans), Microsoft Word (.docx), and plain text (.txt) files up to 50 MB. Scanned image PDFs that contain no selectable text are not currently supported; try the .docx version of the document if you have it.

What does it mean for a clause to be preempted by Colorado law?

A preempted clause is one that a higher law has already overridden. If your CC&Rs restrict something that Colorado Common Interest Ownership Act (C.R.S. § 38-33.3 et seq.) or a federal statute protects, the statute wins and the clause is unenforceable even though it still appears in writing.
